General Terms and Conditions
These are the general terms and conditions of Nouvellune GmbH ("Provider", "we")

  1. Scope of application
    These terms and conditions shall apply to all purchase contracts between us and our customers ("Buyer", "you"), subject to a corresponding inclusion agreement. Your own general terms and conditions shall not become part of the contract, even if we do not expressly object to them. There are no other ancillary agreements. Corporate customers please note clause 8 of these terms and conditions.
  1. Prices and shipping costs, delivery area
    We deliver within Germany, Austria and Switzerland. The shipping costs within Germany and Austria are 3,90€. From an order value of 30€ your delivery is free of shipping costs. For Switzerland we charge 4,90 € shipping costs. These are waived for an order value of 40€.
  1. Conclusion of contract
    Our offers for a large number of potential buyers in catalogues, brochures and on our website are non-binding unless otherwise indicated. A contract is regularly only concluded through your order (application) on the one hand and our express or conclusive declaration of acceptance on the other, e.g. by sending an order confirmation or the ordered goods. If we have not accepted your order within four working days (or 14 working days in the case of deliveries abroad) after it has been placed, you are no longer bound by your order.

    Procedure for orders in electronic business transactions:
    Only the German language is available for concluding a contract in electronic business transactions - i.e. via our Internet pages. Please first search for the desired products on our Internet pages via the categories or the product search. By clicking in the list of results you will get detailed information for the respective product and you can put it in the virtual shopping cart in the desired quantity with the "shopping cart" button without obligation. You can change or delete the contents of the shopping basket. When you have all the products you want in your shopping basket, go to "Checkout". After entering your personal data or logging in again to a previously created online customer account, we will ask you for your payment and delivery preferences. Finally, you will be given the opportunity to check all the details and the order again in an overview and, if necessary, to correct them using the functions displayed there; the order is not triggered until you press the "order subject to payment" button. You will then immediately receive our electronic confirmation of receipt of your order at the e-mail address you provided, which in itself does not constitute a contractual declaration.

    The text of the contract will be saved by us. Only if you create an online customer account and order via it will you be able to access the content of these orders later. However, the general terms and conditions are only available on our Internet pages in the current version. We therefore recommend that you permanently save our e-mails with the order confirmation, as these specify the products ordered, and the terms and conditions applicable at the time of conclusion of the contract are attached.
  1. Payment
    On the Internet, we offer the following payment methods via our service provider STRIPE: instant bank transfer, Paypal, credit card (Visa, Mastercard, American Express), Giropay and SEPA direct debit; the payment method is debited on the day the order is received. Depending on the scope of the order, previous purchasing and payment behaviour and any credit rating obtained, we reserve the right to refuse a desired method of payment and to offer other methods of payment. The delivered goods remain our property until full payment has been made.
  1. Delivery
    We deliver in Germany within approx. 2-3 working days, unless otherwise stated with the article. For delivery to the rest of the EU and to Switzerland we need 3 - 7 working days in each case. Should a part of the order not be available for immediate delivery, we are entitled to make partial deliveries to a reasonable extent; the remaining goods will then be delivered at a later date without additional shipping costs.

    We are entitled to withdraw from the contract insofar as ordered goods are permanently not available and we are not responsible for this circumstance (e.g. force majeure or no self-supply despite timely covering transaction if we have not assumed the procurement risk). In this case, we will inform you immediately and refund any deposits made.
  1. Defects and customer service
    The statutory liability for defects applies with a period of two years from delivery. Please contact us, you will find our contact details on our website.
  1. Cancellation policy for consumers Right of cancellation:
    You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the last goods. To exercise your right of withdrawal, you must inform us (Nouvellune GmbH, Untere Paulistrasse 51, 8834 Schindellegi-Feusisberg, Switzerland, e-mail: support@nouvellune.com) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter or e-mail sent by post). You can use the attached model withdrawal form for this purpose, which is, however, not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

    Satisfaction guarantee:
    We stand behind the quality and effectiveness of our products. However, if you were not satisfied with our products, we offer a 100-day satisfaction guarantee and are willing to refund your purchase.

    Consequences of cancellation:
    If you withdraw from this contract, we must repay you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

    You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the end of the period of fourteen days. We will bear the costs of returning the goods within Germany if you request our return note (DHL) for the return and use it as intended. Otherwise, you will bear the direct costs of returning the goods. You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

    Note: The right of withdrawal does not apply to contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

  1. Entrepreneurs as buyers
    These terms and conditions are not intended for buyers who are entrepreneurs (§ 14 BGB). Entrepreneurs are required to conclude contracts with the supplier under separate corporate customer conditions; exclusively in this case, the supplier grants corporate customer conditions. The supplier is entitled to withdraw from the contract if a buyer proves to be an entrepreneur when these terms and conditions are included.
  1. Other
    German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the reference standards of international private law. Mandatory consumer protection regulations at the buyer's place of residence remain unaffected.
